This document sets out the general terms and conditions of use and contracting through the Aquijóias website, and governs the rights and obligations of Aquijóias and its Customers/Users. By using this website or placing an order, the User/Customer accepts these terms and conditions.

1. Aquijóias Website and Ownership

1.1. The website www.aquijoias.com (hereinafter referred to as the ‘site’) is owned by Aquijóias Joalharia e Ourivesaria, Lda. (hereinafter referred to as “Aquijóias” and further identified in the following section of these General Conditions), which is also the holder of the domain name “aquijoias.com.”

1.2. For the purposes of complying with applicable legal requirements, the complete identification details and mandatory references of the site owner and supplier of the products offered to the public through it are as follows:

1.3. For the purposes of the applicable legislation on personal data protection, Aquijóias, as identified above, is the entity responsible for processing the personal data provided by users of the site.

2. Purpose

These terms govern the use of the website, the purchase of products available in the Online Store, and the responsibilities arising from its use.

3. Use of the Website

The User undertakes to use the website in accordance with the law, good practices, public order, and these conditions. The website may not be used for fraudulent purposes or in a manner harmful to third parties.

4. Products and Availability

The products displayed on the website are subject to stock availability. Aquijóias reserves the right to modify, replace, or withdraw products without prior notice.

5. Prices and Payments

Prices shown include VAT at the legal rate in force and are expressed in euros.
Aquijóias only sells within Portugal and the European Union.
Available payment methods will be presented at checkout.

6. Shipping and Delivery

Orders are dispatched after payment confirmation.

Delivery times vary by destination: generally 2 to 7 working days for mainland Portugal and islands, and up to 15 working days for other EU countries.

Free shipping on orders over €50 (valid only for Portugal and EU).

7. Right of Withdrawal (Returns)

In accordance with Decree-Law No. 24/2014, the Customer has 14 days from receipt of the order to withdraw from the contract without giving any reason.
To exercise this right, the Customer must contact us by email (aquijoias@hotmail.com), indicating their intention to return.
Products must be returned in perfect condition, complete, unused, and in their original packaging.
Goods made to the consumer’s specifications or personalized are excluded from the right of withdrawal.

8. Warranty and Complaints

In accordance with Decree-Law No. 84/2021, non-consumable movable goods benefit from a 3-year warranty.
The Customer must notify Aquijóias of any lack of conformity within 2 months of its detection.

Complaints must be submitted in writing to aquijoias@hotmail.com.

9. Liability

Aquijóias is not liable for interruptions, viruses, or other inconveniences arising from the use of the Internet, except in cases of willful misconduct or gross negligence.

10. Personal Data Protection

The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and Law No. 58/2019.

Data collected is used solely for purposes related to contract performance, invoicing, marketing communications (where authorized), and legal obligations.

Customers may exercise their rights of access, rectification, erasure, restriction, objection, and portability by emailing aquijoias@hotmail.com.

11. Intellectual Property

All content, trademarks, logos, and materials available on the website are the property of Aquijóias or third parties who have authorized their use.

Reproduction without authorization is prohibited.

12. Alternative Dispute Resolution

In the event of a consumer dispute, the Customer may resort to the Lisbon Consumer Conflict Arbitration Centre (CACCL) or any legally competent Consumer Alternative Dispute Resolution Entity.

13. Governing Law and Jurisdiction

These conditions are governed by Portuguese law.

Any disputes arising from the use of the website or the purchase of products shall be submitted to the courts of the Caldas da Rainha district, with express waiver of any other jurisdiction.

14. Amendments to the Terms

Aquijóias reserves the right to amend these Terms and Conditions at any time, with updated versions published on the website.
